I put some flowers on a memorial bench to my late wife and removed them when they started to fade away. But then got a letter from the council complaining that I had put them there against terms and conditions and that if I did not they will remove them!!

I have responded and suggested that they relook at these terms and conditions and that most memorials have flowers placed on them at some time and I have seen lots on the memorial benches near Christmas time.

What are your thoughts??

That's ridiculous John,

Makes me sick to think the crap we put up with with the Council and litter etc and they complain about that?

I'd write to the papers and ambarress them!

Sorry for your loss mate..

I had a long response from the council to say basically:-

Though these benches are a memorial to our loved ones, they are still part of Tendring District Councils Public Seating.

Unfortunately tying flowers onto the bench, can damage the bench. If the flowers start to wilt the wood does absorb the residue as it can make it look patchy if the wood is absorbing the nutrition’s from the flowers. Also a lot do not remove them when they are finished and they have to add that extra job.

These terms and conditions are in place for the above reasoning’s. Therefore we reserve the right to remove any adornments.

On our inspections in the past week we have contacted all of those with adornments attached.

I have responded asking for a rethink and possible giving information/advice on how the best way place flowers on the benches that they have donated in memory of a loved one. I coped in our local councillors with the hope of some support on this.??

A quick response but!!:

Unfortunately we will be unable to allow you to continue to tie any adornments whether they are in a container or directly to the bench. As per our previous email, you had signed agreeing to the T&C’s. The signing of the T&C’s does mean that you have accepted the consequences for if you fail to comply with the T&C’s. In this instance the removal of any flowers.

Tendring District Council will not be reviewing the Terms and Conditions of the memorial benches. It has only been in the recent months we have had an influx of flowers etc. tied to the benches, unfortunately that does mean multiple letters had been sent, to not only to yourself, but other donators.

I await what comments I get from the councillors???
